The Sale of Government Records is Illegal

Government records are created with public funds and belong to the citizens of the State of New Mexico. Chapter 14, Article 5 NMSA 1978 - Public Records Recovery Act (will open in new window) governs the recovery of public records in New Mexico.

The Council of State Historical Records Coordinators released a statement in 2004 with regard to this issue. The Council requested eBay's assistance in alerting customers who seek to purchase and collect public records.

The New Mexico Commission of Public Records supports the Council's initiative and we encourage everyone to read the Council's statement which is available at http://www.statearchivists.org/issues/publicrecordssales/statement.htm (will open in new window).

If you discover New Mexico government documents being sold on eBay or any other site, please alert our office as soon as possible.
